Uz po\u0161tovanje zakonskih uslova, cijeli proces mo\u017ee biti zavr\u0161en u roku od nekoliko dana. Ovaj vodi\u010d obja\u0161njava sve klju\u010dne korake koje treba da znate prilikom <strong>kupovine nekretnine u Crnoj Gori<\/strong>, bilo da ste doma\u0107i ili strani kupac.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">1. Odabir nepokretnosti i provjera dokumentacije<\/h2>\n\n\n\n<p>Nakon \u0161to izaberete nepokretnost, prvi korak je provjera <strong>imovinsko-pravne dokumentacije<\/strong>.<br>To podrazumijeva uvid u <strong>List nepokretnosti<\/strong> izdat od strane Uprave za nekretnine, radi provjere:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>prava svojine,<\/li>\n\n\n\n<li>eventualnih tereta (hipoteka, sudskih sporova, zabilje\u017ebi),<\/li>\n\n\n\n<li>ograni\u010denja u raspolaganju.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">2. Uskla\u0111ivanje uslova i priprema ugovora<\/h2>\n\n\n\n<p>Kada se kupac i prodavac usaglase oko uslova (kupoprodajna cijena, rokovi, na\u010din pla\u0107anja), sa\u010dinjava se <strong>ugovor o kupoprodaji<\/strong>.<br>Ugovor priprema <strong>javni bilje\u017enik (notar)<\/strong>, koji je mjesno nadle\u017ean za podru\u010dje gdje se nepokretnost nalazi.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">3. Prisustvo ugovornih strana<\/h2>\n\n\n\n<p>Za ovjeru ugovora potrebno je:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>prisustvo obje strane ili njihovih punomo\u0107nika sa ovjerenom punomo\u0107i,<\/li>\n\n\n\n<li>ako u\u010destvuje pravno lice \u2013 dostavlja se izvod iz CRPS-a (ne stariji od 3 mjeseca), statut ili akt o osnivanju, te ovla\u0161\u0107enje za zastupanje,<\/li>\n\n\n\n<li>ako je kupac ili prodavac strani dr\u017eavljanin \u2013 obavezno je prisustvo <strong>sudskog tuma\u010da<\/strong> za njegov jezik.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">4. Porez na promet nepokretnosti (3%)<\/h2>\n\n\n\n<p>Kupac je obavezan da plati <strong>porez na promet nepokretnosti<\/strong> u iznosu od <strong>3%<\/strong> od ugovorene ili tr\u017ei\u0161ne vrijednosti.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Poreska prijava se podnosi Poreskoj upravi,<\/li>\n\n\n\n<li>Rok za uplatu poreza je <strong>15 dana<\/strong> od dana zaklju\u010denja ugovora.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">5. Uknji\u017eba prava svojine<\/h2>\n\n\n\n<p>Pravo svojine se sti\u010de tek nakon <strong>upisa u katastar nepokretnosti<\/strong>. Na osnovu ovjerenog ugovora, zahtjev za uknji\u017ebu mo\u017ee podnijeti:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>notar po slu\u017ebenoj du\u017enosti (naj\u010de\u0161\u0107e odmah nakon ovjere), ili<\/li>\n\n\n\n<li>kupac li\u010dno u Upravi za nekretnine.<\/li>\n<\/ul>\n\n\n\n<p><strong>Va\u017eno:<\/strong> Samo pla\u0107anje cijene ne zna\u010di i sticanje prava svojine \u2013 u Crnoj Gori vlasni\u0161tvo se sti\u010de isklju\u010divo uknji\u017ebom u katastar.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">6. Tro\u0161kovi<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Notarske takse<\/strong> zavise od vrijednosti nepokretnosti i odre\u0111ene su Tarifom o nagradama i naknadama notara.<\/li>\n\n\n\n<li><strong>Geodetske usluge<\/strong> (npr. provjera me\u0111a kod kupovine zemlji\u0161ta) napla\u0107uju se posebno od strane ovla\u0161\u0107enih geodeta.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">7.
